Important Notice
This agreement governs the rental of camera, audio, lighting, grip and expedition equipment by Spitsbergen Invest AS (Saga Productions) to professional clients. It does not cover rentals where an operator is provided by Rental Company. Clients are advised to seek independent legal advice before entering into this agreement. This agreement is adapted for use under Norwegian law, with Oslo as legal venue.

Definitions
"Rental Company" means Spitsbergen Invest AS, org.nr. 917 248 932, trading as Saga Productions, with registered address at Mellemveien 7, 1363 Høvik, Norway. "Client" means the entity or individual identified in the rental enquiry confirmation and booking email. "Equipment" means all camera, lighting, audio, grip, monitoring, expedition and vehicle assets listed in the confirmed rental order. "Rental Period" means the period from the confirmed pickup date to the confirmed return date, inclusive. A minimum of one (1) day applies. "Rental Agreement" means this document together with the confirmed booking email issued by Rental Company.

Formation of Agreement
A binding rental agreement is formed when Rental Company issues a written booking confirmation to Client by email. The rental enquiry submitted via sagaproductions.no constitutes an offer; the booking confirmation constitutes acceptance under Norwegian contract law. Rental Company reserves the right to decline any enquiry without obligation. No equipment will be released until written confirmation has been issued and, where applicable, a deposit received. These Terms and Conditions govern all rentals. In the event of conflict between any booking confirmation and these Terms and Conditions, these Terms and Conditions shall prevail unless expressly varied in writing by Rental Company.

Condition and Testing
Rental Company warrants that all Equipment is free from known defects and in good working order at the time of pickup, to the best of Rental Company's knowledge. Client or Client's representative shall inspect and test all Equipment at the time of pickup. By accepting the Equipment, Client acknowledges that it is in good and working order. Any discrepancy must be reported immediately and in writing at time of pickup. If Client discovers a malfunction during the Rental Period not caused by Client's negligence, Client shall notify Rental Company immediately in writing. Rental Company will endeavour to provide substitute Equipment where available. Rental charges for confirmed non-functioning Equipment returned to Rental Company shall be abated from the time of written notification and return.

Payment and Pricing
All prices are stated in Norwegian kroner (NOK). Norway-based rentals are subject to 25% VAT in accordance with Norwegian VAT law. Rentals delivered to and used exclusively on Svalbard are exempt from Norwegian VAT under the Svalbard Act and applicable Norwegian VAT regulations. Payment terms will be specified in the booking confirmation. Rental Company may require a deposit or full prepayment before releasing Equipment. Late payment shall accrue interest at the statutory rate prescribed by Norwegian law. Volume discounts apply as follows: Day 1 — full rate; Day 2 — 10% discount; Day 3 — 20% discount; Day 4 and beyond — 40% discount per day. Discounts apply to daily rental rates only, not to admin fees or insurance contributions. A minimum admin fee applies per rental (NOK 500 mainland Norway; NOK 5,000 Svalbard). A daily insurance contribution applies as stated in the booking confirmation.

Risk of Loss
Risk of loss and damage passes to Client the moment Equipment comes into Client's custody and control — when Client or Client's representative collects Equipment from Rental Company's premises, or when Rental Company delivers Equipment to Client. Client assumes all risk of loss or damage throughout the Rental Period, whether or not covered by Client's insurance, except to the extent loss arises directly from Rental Company's negligence or wilful misconduct. If Equipment is transported at Client's request by a third-party carrier, Client assumes all risk of loss in transit and all transportation costs. Risk reverts to Rental Company only upon physical return and written acknowledgment by Rental Company.

Use of Equipment
Client shall use Equipment only for its intended professional purpose and in accordance with the manufacturer's instructions and applicable Norwegian law. Equipment may only be operated by qualified professionals with appropriate technical competence. Where Equipment requires a licence under Norwegian law (including vehicle operation), only duly licensed personnel may operate such Equipment. Client shall not sub-rent, lend, pledge or transfer Equipment to any third party without Rental Company's prior written consent. Client shall keep Equipment secure at all times. Client shall back up all media promptly and clear all data from Equipment prior to return. Rental Company is authorised to clear Equipment of any remaining content upon return.

Insurance
Client is strongly encouraged to maintain comprehensive equipment insurance covering the full replacement value of all rented Equipment throughout the Rental Period. Rental Company includes a daily insurance contribution in all bookings as stated in the booking confirmation. This provides a basic level of coverage but does not release Client from liability for loss or damage caused by Client's negligence, wilful acts or breach of these Terms and Conditions. Client shall, upon request, provide evidence of insurance to Rental Company prior to pickup. Rental Company maintains its own liability insurance in accordance with applicable Norwegian requirements; details available upon request.

Damage and Missing Equipment
Client is responsible for all costs of repair or replacement (without deduction for depreciation) of Equipment that is lost, stolen, damaged or destroyed during the Rental Period as a result of Client's use, possession, transportation or failure to return Equipment. Rental Company will provide Client with a written statement of missing or damaged Equipment within three (3) business days of return, and will forward repair or replacement cost estimates upon receipt. Replacement value is determined by the manufacturer's recommended retail price at the time of loss or damage, without deduction for depreciation, unless otherwise agreed in writing. Client may have a representative verify returned Equipment at a mutually agreed time within the first business day of return.

Delivery and Return
Equipment is available for collection from Mellemveien 7, 1363 Høvik, Bærum, during agreed pickup hours confirmed in the booking confirmation. For Svalbard rentals, collection is from the agreed Longyearbyen location. Delivery is available on request at an additional cost agreed in writing prior to commencement of the rental. Equipment must be returned in the same condition as received, cleaned, packed, and complete with all accessories, cases and ancillary items. Late return results in additional rental charges at the full daily rate with no volume discount for each day or part-day beyond the confirmed return date. If Client is unable to return Equipment on time, Client must notify Rental Company immediately in writing.

Default
Client is in default if: (a) Client fails to make payment when due; (b) Client fails to return Equipment by the confirmed return date; (c) Client uses Equipment in breach of these Terms and Conditions; (d) Client becomes insolvent or enters debt restructuring or bankruptcy proceedings under Norwegian law. Upon default, Rental Company may, to the extent permitted by Norwegian law, immediately terminate the rental, demand return of Equipment, and pursue all available remedies including recovery of outstanding charges, repair and replacement costs, and reasonable legal and collection costs.

Limitation of Liability
To the fullest extent permitted by Norwegian law, Rental Company shall not be liable for indirect or consequential losses including loss of production, loss of data, loss of profits, or additional production expenses. Rental Company's total aggregate liability shall not exceed the total rental charges paid by Client for the Rental Period in question. Nothing herein excludes or limits liability for death or personal injury caused by negligence, or for fraud, as required by Norwegian mandatory law.

Indemnity
Client agrees to indemnify, defend and hold harmless Rental Company and its officers, employees and agents against any and all claims, actions, damages, liabilities and expenses arising from: (a) Client's use, possession or operation of Equipment; (b) Client's breach of these Terms and Conditions; or (c) the negligence or wilful misconduct of Client, its employees, agents or contractors. Rental Company agrees to indemnify and hold harmless Client against claims arising solely from Rental Company's own negligence or wilful misconduct, or Rental Company's failure to maintain required insurance.

Data Protection
Rental Company processes personal data provided during the rental enquiry and booking process for the purpose of administering the rental agreement and communicating with Client. This processing is carried out in accordance with Norwegian data protection law (implementing GDPR). Client data will not be shared with third parties except as required to fulfil the rental or as required by law. Governing Law and Jurisdiction
This Agreement is governed by the laws of Norway. The parties submit to the exclusive jurisdiction of Oslo District Court (Oslo tingrett) for resolution of any dispute arising under or in connection with this Agreement, unless mandatory Norwegian law provides otherwise. If any provision is found to be invalid or unenforceable under Norwegian law, the remaining provisions shall continue in full force and effect.

Entire Agreement
These Terms and Conditions, together with the booking confirmation email, constitute the entire agreement between Rental Company and Client and supersede all prior representations, understandings and agreements, whether oral or written. Any variation must be agreed in writing and confirmed by an authorised representative of Rental Company. An electronic version of this document, including acceptance via the online booking form at sagaproductions.no, constitutes valid consent equivalent to a signed original in accordance with Norwegian contract and e-commerce law.
Equipment Handover & Signature
Physical signatures are collected at the point of equipment handover using a Saga Productions iPad. Both Rental Company and Client sign digitally at pickup, confirming that the equipment list is correct and that the Client has read and agrees to these Terms and Conditions.

Online booking enquiries accepted via sagaproductions.no constitute valid consent to these Terms and Conditions under Norwegian law. A booking is confirmed only upon written confirmation from Rental Company — not at the point of online enquiry.
Online Booking
Enquiry submitted via sagaproductions.no → booking confirmation email from Saga Productions = binding agreement. No physical signature required for the online flow.
iPad Handover Signature
At equipment pickup, Client and Saga Productions representative both sign on iPad. The signed equipment list and agreement acceptance are emailed to Client immediately.
For iPad Handover App
The iPad checkout app collects: Client name · company · signature · date · equipment list confirmation. A PDF record is generated and emailed to both parties. Contact info@sagaproductions.no for the handover workflow.
